Vietnam: Release of Decree No. 219/2025

In our Spotlight on APAC series, we round up the latest developments across the region. Pursuant to our earlier post on Vietnam: Understanding Vietnam’s Draft Decree for Foreign Employees and Its Key Changes, we outlined how Vietnam was preparing to update its rules for foreign workers. As of 8 August 2025, those proposals have now taken shape with the release of Decree No. 219/2025.

Realignment of Licensing Authority for WP and WP Exemptions

All work permit matters are now officially handled by the provincial People’s Committees where the foreign employee will work. Unlike the previous system, no new application is required when transferring to another province for work.

 

Exemptions

For Short Term Work

Foreign workers who are managers, executives, experts, or technicians coming to work in Vietnam for less than 90 days within a calendar year are now eligible for WP exemption.

 

For Specialised Job Skills and Contributions to Economy

The list of WP exemptions grew from 14 to 15 categories, now including science, technology, innovation, digital transformation, and other priority sectors.

 

Simplified WP Exemption Extensions

Personal updates require only notification, and WP exemptions may be extended once for up to 2 years.

 

Streamlining of WP and WP Exemption Applications

Employers are only required to fill Form No. 03 for WP/WP exemption applications, with a 10-working-day processing timeline, under the new Decree.

 

Health Certificates

Foreign-issued health certificates are valid in Vietnam if there is a mutual recognition agreement between Vietnam and the issuing country.

 

Integrated processing for WPs and Criminal Record Processing

Applications for WPs and criminal record certificates can now be submitted simultaneously via the National Public Service Portal.

 

Notification for certain WP Exemptions

Certain WP-exempt cases are no longer required to apply for a certificate and only need to file a notification least three working days before commencement. This applies for organisational leaders, short-term assignees, licensed professionals, investors with significant capital contributions, and family-related cases.

 

Requirement for Experts and Technicians

The required experience under the Expert and Technicians categories has been shortened.

 

WP Duration Assessment

Validity now depends on supporting documents, such as contracts, assignment letters, and licenses.

 

Mandatory use of Electronic Identity Accounts (VNeID)

Employers must use VNeID accounts for all WP and WP exemption filings, and any other administrative procedures, both online and offline.
