Vietnam: Hanoi Transfers Work Permit Processing to Commune and Ward-Level Authorities

In our spotlight on the APAC series, we round up the latest developments across the Asia Pacific Region. In this update, we highlight a change to the processing framework for foreign employees working in Hanoi, reflecting a continued shift towards the decentralisation of immigration and labour administration.

The Hanoi Department of Home Affairs (DOHA) has transferred responsibility for several work permit–related processing steps to the People’s Committees at the commune and ward level in Hanoi.

Scope of Transfer of Authority

Under the revised framework, commune- and ward-level People’s Committees are responsible for processing matters relating to foreign employees working in Hanoi outside industrial zones and hi-tech parks, including:

  • Issuance of work permits
  • Re-issuance of work permits
  • Extensions of work permits
  • Revocation of work permits
  • Issuance of work permit exemption certificates
  • Receipt of employer notifications

Applications will continue to be submitted through the one-stop service counter. Hanoi DOHA will continue to provide guidance and training to local authorities and will remain responsible for handling escalated or complex cases.

Practical Impact and Considerations

Applicants and employers should be prepared for variations in the interpretation of legal requirements across different local authorities, an increased need for follow-ups with commune- and ward-level offices—particularly during the initial implementation phase—and potential processing delays as procedures and practices are standardised.

In addition, the online application system will require updates to reflect the revised allocation of authority, which may result in temporary disruptions.
