Singapore: Key Considerations for Employers and Foreign Employees

  1. Converting Short-Term Stay to Long-Term Status

Foreign nationals may convert a short-term stay into a long-term immigration pass in Singapore after approval of the relevant application. Applicants must be physically present in Singapore to complete in-country formalities. For most pass types, individuals may remain in Singapore while their applications are under review. However, they must depart if their Short-Term Visit Pass (STVP) expires before approval is granted.

Exception: Non-Malaysian Work Permit applicants must not enter Singapore until approval is issued.

 

  1. Renewal of Long-Term Passes

Most long-term passes are renewable without a fixed limit, subject to prevailing eligibility criteria at each renewal. Where renewal criteria are not met, employers may consider alternative pass types. If no suitable option is available, the pass must be cancelled at the end of employment, and the individual must depart Singapore before the expiry of the STVP issued upon cancellation.

  • Certain passes are non-renewable or have an age limit includes:
  • Training Employment Pass;
  • Training Work Permit;
  • Work Permits where subject to maximum employment periods applies;
  • Dependant Pass for unmarried children including legally adopted children, until they turn 21 years old; and
  • Long-Term Visit Pass for unmarried, disabled children and unmarried stepchildren, until they turn 21.

 

  1. Travel and Re-Entry

Work pass holders may travel freely in and out of Singapore while their passes and passports remain valid. If a pass expires or is cancelled, re-entry is permitted only as a short-term visitor with no right to work, subject to nationality-based visa requirements. Extended duration of absences outside Singapore may affect employment status and work permit validity.

 

  1. Permanent Residence and Citizenship

Employment Pass and S Pass holders, along with eligible family members, students, and investors, may apply for Permanent Residence (PR). Citizenship applications are available to eligible PRs, spouses and children of Singapore citizens, and qualifying PR students. All applications are assessed holistically by the Immigration and Checkpoints Authority, considering economic contribution, family ties, length of residence, and integration into Singapore society.

 

Takeaway for Employment Employment-Related Obligations

Employers must cancel work passes within one week of the employee’s last working day or permanent departure from Singapore. Upon cancellation, short-term stay privileges are typically issued (up to 90 days for Employment Pass holders, 30 days for S Pass holders, and up to 14 days for Work Permit holders). No work activities may be undertaken after cancellation. Alternatively, the individual can consider applying for other passes to continue staying in Singapore should they meet the eligibility criteria of the related passes.

  • Studying: There are no restrictions for a work pass holder to study in Singapore, subject to the requirements of the institution as the Work Pass may need to be cancelled for the issuance of a Student Pass in some situations.
  • Promotions and Salary adjustments: Promotions and role changes are permitted but may require notification to the Ministry of Manpower (MOM). Salary reductions must be notified in advance and may affect pass and dependant eligibility. Salary increases generally require no action unless dependant privileges are sought.
  • Additional information: Work pass holders may only work for their sponsoring employer and must not take on additional employment. One Pass holders are permitted to work for multiple companies concurrently.
