India: New Rules for OCI Cardholders

The Ministry of Home Affairs (MHA) has implemented several changes that will impact foreign nationals of Indian origin and existing OCI (Overseas Citizen of India) cardholders.

Eligible foreign nationals may now apply for an OCI card without completing the previously required 6 months stay in India. Applicants may submit their OCI application shortly after entering India, provided they meet the eligibility criteria. Additionally, eligible foreign nationals may now obtain an electronic OCI (e-OCI) while the physical OCI card has become optional. These updates are expected to streamline application timelines and improve administrative efficiency.

For OCI cardholders who obtain a new passport, they are required to update their passport details on the OCI portal within 3 months of the issuance date of the new passport. Failure to comply may result in a penalty of USD 25.

In addition, fifth- and sixth-generation Indian-origin Tamils in Sri Lanka are now included under the OCI programme, whereas eligibility was previously limited to fourth-generation descendants. This expansion will benefit a larger section of the Sri Lankan diaspora, particularly communities with limited historical documentation.
